1. PROMOTION PERIOD
1.1 The Malt Donkey Origin Terroir Tour Giveaway (“Promotion”) commences at 8:30am AEST on 31.08.26 and closes at 11:59pm AEST on 30.09.26 (“Promotion Period”).
1.2 Entries received outside the Promotion Period will not be valid. 1.3 The Promoter reserves the right to amend the Promotion Period where reasonably necessary and where permitted by applicable law.
2. WHO CAN ENTER
2.1 Entry is open to Australian residents aged 18 years or over, excluding residents of the Australian Capital Territory (“ACT”).
2.2 Residents of the ACT are expressly excluded from this Promotion and are not eligible to enter or win the Prize.
2.3 The Promotion is open to eligible residents of New South Wales, Victoria, Queensland, South Australia, Western Australia, Tasmania and Northern Territory.
2.4 Employees, officers and contractors of Malt Donkey Pty Ltd, its related entities, participating suppliers and their immediate family members are not eligible to enter.
2.5 The Promoter may request reasonable evidence of an entrant’s identity, age and residential address.
2.6 If an entrant is found to be ineligible, their entry may be declared invalid and, if they have been selected as the winner, the Prize may be forfeited and awarded to a reserve entrant in accordance with these Terms and Conditions.
3. HOW TO ENTER
3.1 To enter the Promotion, an eligible entrant must, during the Promotion Period: visit the official Malt Donkey website; make a qualifying purchase of Malt Donkey products; enter the promotional code VISITMD26 at checkout; and successfully complete the purchase.
3.2 The promotional code provides the entrant with 10% off their qualifying purchase, subject to these Terms and Conditions and any product exclusions communicated at the time of purchase.
3.3 Each qualifying purchase made using the promotional code constitutes one entry into the Promotion.
3.4 Entrants may make multiple qualifying purchases during the Promotion Period and each qualifying purchase will constitute a separate entry.
3.5 An order that is cancelled, refunded, reversed, fraudulent, incomplete or otherwise invalid will not constitute a valid entry.
3.6 The Promoter reserves the right to verify entries and exclude any entry that does not comply with these Terms and Conditions.
3.7 No separate entry fee is payable.
3.8 The purchase price of qualifying Malt Donkey products is not increased because of the opportunity to participate in the Promotion.
4. PROMOTIONAL DISCOUNT
4.1 Eligible entrants will receive 10% off qualifying purchases when the promotional code is correctly applied at checkout.
4.2 The 10% discount is available during the Promotion Period only.
4.3 The discount is subject to any exclusions displayed on the Malt Donkey website.
4.4 Unless otherwise stated, the discount cannot be used in conjunction with another discount, promotion or offer.
4.5 The discount cannot be exchanged for cash or transferred to another person.
4.6 Delivery charges and other applicable charges are not discounted unless expressly stated otherwise.
4.7 The Promoter reserves the right to cancel or refuse a transaction where the promotional code has been used fraudulently or contrary to these Terms and Conditions.
5. THE PRIZE
5.1 One eligible entrant will win an Origin Terroir Tour for two people in South Australia (“Prize”).
5.2 The Prize is designed as a behind-the-scenes Malt Donkey experience celebrating South Australia’s barley and wine regions and the provenance of Malt Donkey’s Fine Ales.
5.3 The Prize currently includes: return economy flights to Adelaide for two people; relevant transfers within South Australia; two nights’ accommodation for two people in the South Australian wine and barley regions, including breakfast; a private behind-the-scenes tour of the Malt Donkey Malthouse in the Adelaide Hills; an exclusive tasting of Malt Donkey M Series Fine Ales hosted by the Malt Donkey team; a long lunch at a leading Adelaide Hills restaurant; and any other inclusions expressly communicated by the Promoter as part of the Prize.
5.4 The total retail value of the Prize is AUD < AUD $4,999 including GST.
5.5 The Prize value will be calculated using the applicable retail or market value of each Prize component at the time the Promotion is advertised.
5.6 The Prize is for two people only.
5.7 The winner may nominate one companion to accompany them on the Prize, subject to the companion meeting all applicable eligibility, age and travel requirements.
5.8 The Prize is subject to availability and the terms and conditions of airlines, accommodation providers, restaurants, transport providers and other third party suppliers.
5.9 Travel dates must be agreed between the winner and the Promoter and are subject to availability.
6. PRIZE EXCLUSIONS
6.1 Unless expressly stated otherwise, the Prize does not include travel insurance; travel to or from the winner’s departure airport; personal travel expenses; additional accommodation; meals or beverages other than those specifically included; alcoholic beverages other than those specifically included; spending money; passport or other travel documentation costs; personal purchases; additional transfers; or any other costs not expressly specified as being included.
6.2 The winner and companion are responsible for all required identification and travel documentation.
6.3 The Promoter recommends appropriate travel insurance.
7. PRIZE CONDITIONS
7.1 The Prize must be taken on dates nominated by the Promoter and agreed with the winner, subject to availability.
7.2 The Prize must be taken within 12 months of notification unless otherwise agreed in writing.
7.3 The Prize cannot be transferred, exchanged for another prize or redeemed for cash.
7.4 The Prize cannot be sold or commercially transferred.
7.5 If a component becomes unavailable beyond the Promoter’s reasonable control, it may be substituted with one of equal or greater value, subject to applicable law.
7.6 Where reasonably practicable, the Promoter will consult with the winner before making any substitution.
8. ALCOHOL AND RESPONSIBLE CONSUMPTION
8.1 Entrants must be 18 years or older.
8.2 Any Malt Donkey Fine Ales included in the Prize may only be supplied to persons legally entitled to receive alcohol.
8.3 The Promoter may request valid proof of age before supplying any alcoholic product.
8.4 The Promotion and Prize will not be administered in a manner that encourages excessive, rapid or irresponsible consumption of alcohol.
8.5 The Prize is centred on provenance, production, food and beverage, and South Australia’s barley and wine regions; it is not intended to encourage excessive consumption of alcohol.
9. DRAW
9.1 The winner will be determined by random draw from all valid eligible entries received during the Promotion Period.
9.2 The draw will take place on 05.10.26 at 9:00am at 195 Woods Hill Road, Ashton Hills, SA 51373. 9.3 Each valid entry will have an equal chance of being selected.
9.4 The winner need not be present.
9.5 The Promoter may draw reserve entries at the same time.
9.6 Reserve entries may be used where the original winner is ineligible, cannot be contacted, fails to claim the Prize or otherwise forfeits it.
9.7 The draw will be conducted fairly and in accordance with applicable law.
10. WINNER NOTIFICATION
10.1 The winner will be notified in writing by email and/or telephone using the contact details provided at entry.
10.2 The winner will be notified within 7 days of the draw.
10.3 Reasonable proof of identity, age and residential address may be required before the Prize is awarded.
10.4 The Promoter may require confirmation of the winner’s nominated companion before travel arrangements are made.
11. CLAIMING THE PRIZE
11.1 The winner must claim the Prize within 14 days of notification unless otherwise agreed.
11.2 If the winner cannot be contacted after reasonable attempts, does not claim the Prize or is ineligible, the Promoter may conduct a further draw.
11.3 Any replacement draw will comply with applicable laws of participating jurisdictions.
11.4 The replacement winner will be notified using the contact details provided at entry.
12. PUBLICATION OF WINNER
12.1 The winner’s name may be published on the Malt Donkey website and/or social media channels.
12.2 Where required by law, winner details will be published in the required manner and period.
12.3 Entrants acknowledge and consent to publication of their name if selected as winner, subject to applicable privacy laws.
13. PRIVACY
13.1 Entrants consent to Malt Donkey collecting and using personal information to administer the Promotion, process and verify entries, conduct the draw, contact the winner, arrange and deliver the Prize, and meet legal and regulatory requirements.
13.2 Personal information will be handled in accordance with Malt Donkey’s Privacy Policy at https://www.maltdonkey.com.au/privacy-policy.
13.3 Entrants who separately opt in to marketing may receive communications in accordance with the Privacy Policy and applicable law.
13.4 Entrants may unsubscribe from marketing at any time.
14. SOCIAL MEDIA
14.1 The Promotion may be promoted through Instagram, Facebook, email marketing, the Malt Donkey website and other channels.
14.2 It is in no way sponsored, endorsed, administered by or associated with Instagram, Facebook or any other social media platform.
14.3 Entrants release relevant social platforms from liability arising from the Promotion to the extent permitted by law.
15. STATE AND TERRITORY ELIGIBILITY
15.1 The Promotion is open to eligible residents of NSW, Victoria, Queensland, South Australia, Western Australia, Tasmania and the Northern Territory.
15.2 ACT residents are expressly excluded.
15.3 Any entry by an ACT resident is invalid and excluded from the draw.
15.4 The Promoter may verify residential address. 15.5 The Promotion will be conducted under applicable trade promotion requirements.
15.6 Where a jurisdiction imposes further requirements, the Promoter will comply before permitting eligible residents to participate.
16. REGULATORY COMPLIANCE
16.1 The Promotion is intended to operate as a trade promotion lottery.
16.2 The winner is determined by chance through a random draw.
16.3 No separate entry fee is charged.
16.4 Entry is connected with purchase of Malt Donkey products.
16.5 The Promoter will comply with applicable trade promotion legislation and regulatory requirements.
16.6 Terms or eligibility may be amended where necessary to comply with law.
16.7 If a permit, licence, authority or approval becomes required, the Promoter may obtain it or amend the Promotion to comply.
17. FAIRNESS AND VALID ENTRIES
17.1 The Promoter may verify the validity of entries.
17.2 An entry may be invalid if the entrant provides false or misleading information, is ineligible or an ACT resident, the purchase is cancelled, refunded or reversed, the entrant engages in fraudulent or improper conduct, the entry does not comply with these Terms and Conditions, or it is otherwise invalid under law.
17.3 The Promoter’s decision regarding validity is final, subject to applicable law.
18. CHANGES, CANCELLATION AND FORCE MAJEURE
18.1 The Promoter may amend, suspend, cancel or extend the Promotion where reasonably necessary due to circumstances beyond its reasonable control or to comply with law.
18.2 The Promotion will not be materially altered after commencement except where permitted or required by law.
18.3 If cancelled, suspended or materially changed, reasonable notice will be provided through the Malt Donkey website and/or other appropriate channels.
19. LIABILITY
19.1 Nothing excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded.
19.2 Subject to law, the Promoter is not responsible for loss, delay, technical failure, telecommunications failure, website failure or circumstances outside its reasonable control that prevent participation.
19.3 The Promoter is not responsible for costs incurred by the winner or companion not expressly included in the Prize.
19.4 The Promoter is not responsible for third-party supplier changes, cancellations or delays, subject to consumer law obligations.
20. CONSUMER RIGHTS
20.1 Nothing in these Terms and Conditions excludes, restricts or modifies rights or remedies available under the Competition and Consumer Act 2010 (Cth) or other applicable consumer protection legislation.
20.2 Any provision inconsistent with a mandatory consumer right or protection will be read subject to applicable law.
21. GOVERNING LAW
21.1 These Terms and Conditions are governed by the laws of Australia and, where applicable, the laws of the state or territory in which the entrant resides.
21.2 The Promotion will be conducted in accordance with all applicable Commonwealth, state and territory laws.
